You agree that your use of the Collegiate Access website will not violate any local, national or international law. All of the information you have provided Collegiate Access is completely accurate with no alterations and is truthful. You have not and will not access other user's passwords, usernames, etc.

By registering for a college coach's account, you must be a NCAA Division I, II, III, NAIA, NJCAA or NCCAA or other college athletic association head coach, assistant coach, athletic director, associate athletic director, and/or official collegiate recruiter. You must have a current school email. If you do not have a school email, contact Collegiate Access at contact@collegiateaccess.net for approval.

To register for a high school or club coach's account, you must be currently employed or have been previously employed by a high school or club organization in the sport of softball.

To register as an athlete, you must in fact be a high school athlete or college student who is looking to transfer to another university as a collegiate athlete.

By registering untruthfully as an athlete, college coach, high school coach or club coach you can and will be held liable for your actions and the consequences. This is considered illegal access to information and Collegiate Access reserves the right to pursue further action.

You have not and will not access those files reserved solely for Collegiate Access administrators and staff. You have not and will not solicit other Collegiate Access users and/or members.

Soliciting registered users of CollegiateAccess.net, either coaches or athletes, is strictly prohibited. Legal action will be taken against any and all persons or companies soliciting registered users of CollegiateAccess.net.

You have not and will not use any of CollegiateAccess.net material (logos, graphics, art works, text, articles, database, internet coding, etc) without written permission from CollegiateAccess.net and the translated documents provided by CollegiateAccess.net. are for your personal and non-commercial use. You may not modify copy, distribute, transmit, display, reproduce, publish, license, create derivative works from, transfer or sell any information or services obtained from CollegiateAccess.net without the express written permission of CollegiateAccess.net.

CollegiateAccess.net is not responsible for the actions of those users (both coaches and athletes) who do not abide by NCAA regulations. CollegiateAccess.net is in no way affiliated with the NCAA, NAIA, NCCAA, or NJCAA. All users are responsible for their own actions. All users are responsible for knowing the NCAA's rules, regulations, and laws. All users are responsible for abiding by the NCAA's rules, regulations and laws. CollegiateAccess.net is not responsible for coaches and/or athletes who violate NCAA or specific sport governing body rules and regulations. Violators are subject to account termination and forfeiture, if any, all fees and or dues.CollegiateAccess.net does not promote any violations of NCAA or specific sport governing body rules or regulations.

CollegiateAccess.net, at its sole discretion, has the right to terminate membership and usage of any users who violate CollegiateAccess.net Terms of Use.

Only actual collegiate athletic coaches are permitted to register for CollegiateAccess.net college coach accounts.

Members -- both coaches and athletes -- agree to only post accurate, truthful information in their CollegiateAccess.net accounts. CollegiateAccess.net is not responsible for any misrepresentation by an athlete, his or her family, or a coach or school.

By registering with CollegiateAccess.net or using CollegiateAccess.net services as an either coach or an athlete you agree to CollegiateAccess.net Terms of Use.

Your access to and continue use of CollegiateAccess.net constitutes your acceptance of all provisions contained herein. If you do not agree with these provisions, you should discontinue all use and exit the site immediately. CollegiateAccess.net reserves the right to amend these terms and conditions at any time and without notice. It is your responsibility to check all updates.

All members agree that use of CollegiateAccess.net is at his/her sole risk. CollegiateAccess.net does not warrant that the service will be uninterrupted or error free. CollegiateAccess.net does not make any warranty as to the results obtained from CollegiateAccess.net usage or as to the accuracy, reliability, or content of any information, service, or merchandise provided through CollegiateAccess.net.

Waiver and Release from Liability for Services from Collegiate Access

Prospect/Parent/Coach/Scout/Fan hereafter referred to as “Customer” does hereby waive and release, indemnify, hold harmless and forever discharge Collegiate Access, hereafter referred to as “CA” and its agents, employees, officers, directors, affiliates, successors, members, and assigns, of and from any and all claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages and liabilities, of every kind and nature, whether known or unknown, in law or equity, that I ever had or may have, arising from or in any way related to the services being provided to me by CA provided that this waiver of liability does not apply to any acts of gross negligence, or intentional, willful or wanton misconduct. Said services may include, but are not limited to, skills video, statistical data, profile updates, tournament or special event analysis, as well as prospect evaluations.

By this Waiver, I (Prospect/Parent/Coach/Scout/Fan) assume any risk, and take full responsibility and waive any claims of personal injury, death or damage to personal property associated with such services by CA including but not limited to temporary or permanent damage to myself or unsatisfactory results from the said services being provided to me.

This Waiver and Release contains the entire agreement between the CA and myself, and supersedes any prior written or oral agreements concerning the subject matter of this Waiver and Release. The provisions of this Waiver and Release may not be waived, altered, amended or repealed, in whole or in part, except by in writing agreed to by CA.

The provision of this Waiver and Release will continue in full force and effect even after the termination of the services being provided to me, whether by agreement, by operation of law, or otherwise.

I have read, understand and fully agree to the terms of this Waiver and Release. I understand and confirm that by agreeing/submitting this Waiver and Release, I have given up considerable future legal rights. I have agreed/submitted to this agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated to me. My acceptance/submitting is proof of my intention to execute a complete and unconditional Waiver and Release of all liability to the full extent of the law. I am 18 year of age or older and mentally competent to enter into this Waiver and Release.
